Court Slams $75,000 USD On Pedophile
A Nigerian court has awarded N15 million, about ($75,000 USD) against an ex policeman who defiled an 11 year old Junior Secondary School boy.
The court was told that the ex cop, Corporal John Unegbu, sometimes in September 2013 at Bwari, a satellite town in the Federal Capital Territory, had unlawful carnal knowledge by defiling the boy whose names are withheld, which led to the boy having serious stomach aches and discharge of whitish fluid from his anus.
Determined to bring the pedophile to justice, the ex cop who had been tried and dismissed by his employers- the Nigeria Police Force, was dragged before Justice Folashade Ojo of the Abuja High Court by an Abuja based Human Rights activist, Ms Esther Uzoma, last year, for the enforcement of the fundamental rights of the boy. She urged the court to declare that the unlawful carnal knowledge , indecent assault and defilement of the tender and vulnerable 11 year old through the anus by Corporal John is inhuman, degrading, unlawful and an abuse of his right to life, respect, dignity of the human person as enshrined in Section 33 and 34 of the Constitution of the Federal Republic of Nigeria 1999 and Articles 4&5 of the African Charter on Human and Peoples Rights( Ratification and Enforcement Act) CAP 10LFN 1999
She also sought a declaration by the court that the action of ex cop amounts to torture, physical and psychological abuse and violation of the boy's right to survival and development as provided for in Section 3,4,11&13 of the Child's Right Act (2003) and that the unlawful carnal knowledge, indecent assault and defilement of the boy was also an outright violation of Section 31 of the Child's Right Act (2003)
The human rights activist therefore asked the court for an order mandating a comprehensive health examination and treatment of the boy at the expense of the accused as well as an order for the payment of the sun of N50million being general damages for physiological torture, trauma and abuse of the little boy. She also sought for the payment of the sum of N10million being exemplary damages for infringement of the boy's Fundamental Rights.
In her judgment delivered on Friday, Justice Ojo ordered the ex Corporal Unegbu to take full responsibility of the treatment of the boy and consequently awarded Five million Naira as exemplary damages and N10million for general damages against Unegbu.
The elated human rights activist, Ms. Esther Uzoma, confirmed that her chambers handled the case free for the boy and that she's also handling six other similar cases within the federal capital territory and neigbouring Nasarawa state. She commended the courage and industry of Justice Ojo stressing that with judicial officers like the judge, that the days of pedophiles would soon be over.
