Illegal Arms: Kogi Lawmaker Gets Bail, Re Arrested
Embattled Kogi state lawmaker who was docked before an Abuja Magistrate Court over illegal possession of arms was granted bail on Tuesday.
The lawmaker, Friday Sani, also known as Makama was allegedly arrested while in possession of illegal firearms.
He was granted bail in the sum of N5 million with one surety who must be a resident of Abuja and must be a grade level 15 officer and above.
The court also granted Sani’s co-accused, Job David bail in the sum of N1 million and one surety in like sum.
The lawmaker's joy over the bail granted him was however short lived as the court further made an order for his re arrest and remand following a further allegation by the prosecution counsel, Mr. Simon Lough, that the police had arrested two armed robbers who made confessional statements to the fact that the lawmaker supplied them with arms and ammunition.
“I will admit the two accused persons to bail but the 1st accused person will be remanded until Friday June 14 to enable the police complete their investigation. The 2nd accused person’s bail commences today hence there are no further allegations against him by the prosecution. I hereby grant the first accused person bail to the sum of N5 million with one surety in like sum. The surety must be resident in Abuja within the jurisdiction of this court, and must be a civil servant on not less than grade level 15” the court ordered.
Relying on section 129(3) of the Criminal Procedure Code which allows the police to apply to keep suspects in the custody pending the completion of investigation, the court ordered that the lawmaker, although granted bail, be remanded in prison custody until Friday June 14 with the hope that the prosecution must have completed its investigation"
Sani, who is the Chairman House Committee on Public Account in Kogi state House of Assembly, was arraigned last Friday alongside Job David.
According to the Police First Information Report, FIR, the two accused persons violated sections 27(1) of the Fire Arms Act CAP F28 LFN 2004.
They were also charged with criminal conspiracy and abatement contrary to section 97 and 85 of Penal Code Law.
The FIR reads:
“On 4th of June 2013 at about 1340hours you Friday Sani aka Makama and Job David were arrested in possession of AK47 rifle with 35 rounds of life ammunition and police walkie talkie and in the course of investigation it was discovered that you aid and abetted Emmanuel Shuaibu (aka Action), Mohammed Musa (aka Lets go), Friday Abams and Adeboni-Musa to possess fire arms to with AK47 rifle and ammunition by issuing them with AK47 rifle and ammunition you thereby committed above mentioned offences."
