Court Threatens To Jail YDP Officials
A federal court in Abuja on Monday threatened to jail officials of the newly registered political party, Youth Democratic Party, YDP, for misrepresenting a judgment delivered by the court earlier in the month in the suit instituted by the party in pursuit of its registration by the Independent National Election Commission, INEC.
The court presided by Justice Ahmed Mohammed had on 4th March ordered the electoral umpire to register the party having complied with the requirements for its registration but the party officials at a press conference held in Abuja, informed the media that the court had also ordered that it be allowed to participate in the forthcoming elections.
The court issued a 24 hour ultimatum to the officials of the Youth Democratic to address to convoke a press conference to retract their misrepresentation of the judgment or risk being sent to jail. The angry judge further ordered the party officials to file an affidavit of compliance with his directive and threatened to jail them if they fail to carry out his directives.
At a proceeding before the court following INEC's application for stay of execution of the court's judgment on 12th March, the court had summoned the party officials to appear in court on today, to explain how they came about the court pronouncement ordering their inclusion in the polls and noted that a case of contempt had been established against the party officials from the two affidavits filed by them.
However the court maintained that since it was not out to unnecessarily join issues with anybody and that in view of plea for mercy by the party's lawyers, the court would reluctantly temper justice with mercy. "It is clear that the court did not order to include them in the ballot papers or to shift the election. The case of contempt is clearly established in the circumstances of this case and learned senior counsel for the plaintiff has pleaded with the court to temper justice with mercy and to forgive the plaintiff's officials.This court is not out to unnecessarily join issues with anyone least of all the officials of the Young Democratic Party. It is on that premise that I will reluctantly temper justice with mercy in this matter subject to the following conditions:
"The officials of the party shall within 24 hours from now call a national press conference and debunk or retract the misrepresentation made against the order of this court that was delivered on March 4, 2015. The officials of the party shall file an affidavit in court for compliance with paragraph (i) of this order. In case of failure to comply with the court's directive herein, this court will not hesitate to commit to prison, the affected officials of the party on the next return date since evidence of contempt has been established" the judge ordered.
The court thereafter adjourned further proceedings in the matter till 31st March.
