Court strikes out suit opposed to Justice Salami's return

A Nigerian court siting in Abuja, on Monday struck out a suit instituted by persons who were opposed to the return of ousted President of Court of Appeal, Justice Ayo Isa Salami.
The suit was calculated to forestall the implementation of a latest recommendation by the National Judicial Council, NJC, the regulatory authority for judicial officers. The body recently called for the reinstatement of the jurist who was forcefully sent on compulsory leave by President Goodluck Jonathan as a fallout of an allegation the jurist levied against erstwhile Chief Justice of Nigeria, Justice Aloysius Katsina Alu.
The order of the court striking out the suit was sequel to a drama which ensued at the last proceedings when the man whose name was purportedly used in instituting the action on 19th June 19, Mr. Wilfred Okoli, told the court that he had no knowledge of the suit filed in his name.
An Abuja based lawyer, Mr. Amobi Nzelu had filed the suit on behalf of Okoli asking the court to stop jonathan from acting on the recommendation sent to him by the National Judicial Council, NJC. Mr. Okoli is a junior lawyer practicing in Mr. Nzelu’s Chambers.
He told the court that he was not aware of this suit filed in his name."My lord, I am not aware of this suit, my consent was never sought before it was brought to before you. I have no knowledge of it," he said.
In the notice of discontinuance dated June 22, Mr Okoli relied on two grounds to urge the court to hands off the matter. According to him, "I neither gave consent nor authorised that the suit be instituted in the first instance. I did not brief anybody whatsoever to commence the suit on my behalf. I do not have any cause of action against Justice Salami or any of the defendants”.The court relied on the motion for discontinuance and struck out the suit. This development further strengthens the return of the courageous jurist to his duty post.
